Welcome to XBOC Custom Coatings. These Terms & Conditions (“Terms”) govern your use of xboccustomcoatings.com (the “Website”) and your communications with XBOC Custom Coatings (“XBOC,” “we,” “us,” or “our”). By using the Website, you agree to these Terms.
Website Use
You may use the Website for lawful, personal, and informational purposes. You may not use the Website in a way that interferes with its operation, attempts to gain unauthorized access to it, introduces harmful code, or infringes another person’s rights.
Website content is provided for general information only. Service availability, project timing, pricing, materials, and finishes may change. Contact us for a current, written estimate for your specific project.
Estimates and Service Agreements
Submitting a form, requesting an estimate, calling us, or receiving an estimate does not create a contract or guarantee that we will perform work. A project becomes binding only when the parties accept a written proposal, contract, or other agreement that identifies the scope of work and applicable terms.
For any installation, resurfacing, coating, flooring, countertop, or related service, the signed project agreement controls the scope, pricing, payment schedule, schedule, change orders, warranty, cancellation rights, and remedies. If a project agreement conflicts with these Website Terms, the project agreement controls for that project, except where applicable law provides otherwise.
Project Conditions and Custom Work
Our work often involves existing concrete and other substrates. Conditions that may affect results include cracks, moisture, prior coatings, substrate movement, weather, drainage, site access, contamination, and ordinary wear. We will discuss material conditions that are reasonably apparent during the estimate or work process; however, hidden or changing site conditions may require additional work, revised pricing, or a change order.
Decorative concrete, stains, overlays, metallic epoxy, chip floors, and hand-applied finishes are custom products. Color, texture, pattern, sheen, and movement can vary because of material batches, concrete condition, lighting, installation methods, and other factors. Unless otherwise stated in a signed agreement, samples and photographs illustrate general style and are not exact guarantees of the final appearance.
Customer Responsibilities
For a project, you are responsible for providing accurate information, obtaining any required approvals or permissions for us to access the property, and providing safe and reasonable access to the work area. You must disclose known site conditions that could affect the work, including prior coatings, repairs, moisture concerns, hazards, and access restrictions.
You are also responsible for protecting personal property, pets, vehicles, and other items not designated for work, unless the signed agreement states otherwise.
Payments, Changes, and Cancellations
Payment, deposits, cancellation, rescheduling, refund, and change-order terms are set out in the applicable written project agreement. Our Refund & Return Policy provides general information but does not replace a signed agreement or any right provided by applicable law.
Requested changes to scope, materials, colors, patterns, timing, or site conditions may require a written change order and may affect price or completion time. We are not required to begin or continue additional work until the change is confirmed in writing.
Intellectual Property
The Website’s text, graphics, logos, photographs, videos, design, and other content are owned by or licensed to XBOC and are protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, modify, publish, or use Website content for commercial purposes without our prior written permission.
Third-Party Websites
The Website may contain links to third-party websites or services. Those links are provided for convenience only. We do not control or endorse third-party content and are not responsible for their availability, privacy practices, or terms.
Disclaimers
